Anotace

V originále

In the year 2022 Israeli Ministry of Innovation, Science and Technology announced launching the National Artificial Intelligence (AI) plan, which is aimed at assisting in a long-term development and implementation of the AI in the public sector. The State of Israel strives to become one of the three leaders in the AI technologies by 2030. The AI systems are being used in many aspects in connection to the issues the State of Israel is facing on a daily basis. One of these issues is terrorism and other security threads. The AI systems can be used as part of autonomous and semi-autonomous weapons, there are AI communication systems which might collect the data and content of the correspondence of its users, so it can collect the data about potential preparation, pursuing, supporting or least but not last financing the terrorist activities of Hamas and Palestinian Islamic Jihad. The use of the AI in the public sector brings several legal issues. One of them is the protection of the human rights. The technologies might have the impact to the prohibition of discrimination, the right to privacy, right to work, right to an adequate standard of living, the right for the continuous improvement of living conditions and on the right to achieve the highest attainable level of physical and mental health. The AI systems are developed and used in practise, while there is still the absence of generally accepted legal rules for the use of AI. The systems should be always used in the way, so they do not interfere with the protection of human rights. They should be used in accordance with currently valid legal framework and not in the way which is contradicting to the subject and purpose of the legal protection. From the perspective of the international law should be also always evaluated, how proportional is the use of AI it in the context of the reasons for use of the AI, including the security threads Israel deals with. This paper is focused on examining the current level of the AI technologies used by the State of Israel in connection to the human rights law.
